COPYRIGHT TAKEDOWN POLICY

At SHL we value the intellectual property rights of others and expect users of our websites (“Sites”) to reflect the same values. If you believe in good faith that a user has uploaded content to a Site that may infringe your copyrights, please send us a takedown notice as required below.

Digital Millennium Copyright Act (“DMCA”) Notice

For copyright infringement notices, SHL will only remove content based on a complete DMCA Notice (“Notice”). A complete Notice must include all of the following information:

  1. A detailed description of the copyrighted work that you claim has been infringed and a description of the infringing activity;
  2. A description of where the material that you claim is infringing is located, such as the URL where it is posted;
  3. Your full legal name, physical address, telephone number and email address;
  4. A statement by you that you have a good faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law;
  5. A statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner’s behalf; and
  6. The electronic or physical signature of the owner of the copyright or the person authorized to act on the owner’s behalf.

Upon review of a complete Notice, SHL will remove the allegedly infringing content. SHL will further make a good-faith attempt to contact the user who stored or transmitted the allegedly infringing content to provide such user the opportunity for a response to the removal of their content (a “DMCA Counter Notice”).

DMCA Counter Notice

If you believe your content was removed by SHL based on an improper Notice (for instance, the content was removed as a result of a mistake or misidentification), you may file a DMCA counter notice (“Counter Notice”) with SHL and request that SHL restore placement of your content. SHL will only restore your content if you provide us with all of the following information:

  1. A detailed description of the content SHL removed and the URL(s) where the content appeared before removal;
  2. Your full legal name, physical address, telephone number and email address;
  3. The following statement: “Under penalty of perjury, I have a good faith believe that the content described in the DMCA Notice was removed or disabled as a result of mistake or misidentification”;
  4. The following statement: “I consent to the jurisdiction of Federal District court for the judicial district of the Northern District of California, and I will accept service of process from the person who provided the DMCA Notice or an agent of such person”;
  5. Your electronic or physical signature.

SHL may, in its sole discretion, reinstate the content based on the Counter Notice. However, in no event will SHL reinstate the content if it receives notice from the copyright claimant that a legal action to restrain the allegedly infringing activity has been filed.
